Working through this module made me more aware of the practical challenges that come up when trying to follow FERPA consistently in real-world situations.
This highlights a question that came up in a zoom review that I was holding. Recording of the session was brought into question during a zoom review session with members of the class. Can one record a session and deseminate to the zoom participants? One point to consider wa whether all of the participants were from the same classs. I have run zoom reviews with students from different campuses and one has to consider disclosure of student information between different classes.
Food vendors on campus may be subject to FERPA regulations
With weakening federal enforcement like the issue of Executive Order 14242 that has directed the closure of the U.S. Department of Education, which traditionally enforced FERPA. This has created uncertainty around who will oversee compliance and how violations will be addressed.
Laws such as the Solomon Act take priority over standardized FERPA laws
If a student opts out of Directory Information sharing, an institution must have the means to block access to it. This has become increasingly difficult with the increase presence of social media, like Facebook. I suppose my role would be to have an awareness of where this information might land so that I can protect the students as well as limiting the institution's liability.
FERPA isnt as strong as i thought it was, theres laws that have priority over FERPA like the solomon Amendment
FERPA must still be followed when classes are online/zoom.
I have learned that when using FERPA all may not always go the way of the student or instructor. it is always good to have a papertrail for protection.
I have learned a lot about FERPA and in the distance education classroom, we have to be careful to look for what FERPA includes in different situations.
I learned FERPA may be overridden in some scenarios and isn't the end all be all.
The laws creating legal boundaries. The excerpt involving the recording for YouTube consumption was revealing. (Distinction between academic freedom and new media consumption is a compelling piece of information)
I learned that a ruling was made that students may not be “anonymous,” even in a distance education setting. Therefore, while certain information is protected, participation in an academic activity can still be required for all students.
I learned that requests from the military for information on students must be supplied when requested.
This section gives many examples of what a FERPA situation can be about including needing permission from students which appear in a Youtube video recorded by a teacher, it also shows that the school can give out personal information to government agencies if the reasoning and need for such information is necessary. It also shows that even if a student wishes to opt out of press release and direct information they are still not allowed to be anonymous in distance learning.
Hippa/Ferpa are the correct guidelines when handling and are always adjusting to maintain technological advances as many of us are turning more electronic/digital than paper.
Comment on Luis Arturo Joachin's post: si tienen una diferencia una protege los registros académicos y el otro protege los registros médicos
While HERPA and HIPPA are very similar, there are some differences.
