Students without disclosure of a disability

What happens if a student with a disability does not disclose that they have a disability right away and are only stright forward after questioning them regarding their poor performance are we obligated to go back and make a accomadations to previous work in the middle of a quarter.

No -- with rare exceptions, accommodations are not retroactive. Students with disabilities have rights, but they also have responsibilities. One of those responsibilities is to identify themselves to an appropriate source and request needed assistance. Until they do that, we are under no obigation to accommodation.

So this means that the student with disability can make a request for an accomodation at any time after disclosing so??

Yes -- and no. The student can make the request at any time. But the basic operating principle is that "both the request, and the accommodation, must be appropriate and timely." So once the request is made, the school must move in a timely manner to provide an appropriate response. BUT... the school is not required to jump through hoops. If the student says (for example), "I need all my books in Braille... by Friday!", when the school personnel stop laughing they can let the student know that is NOT gonna' happen!
