Instructors
can a current instructor be a student at the same institution but higher level than what he teaches? (Ex, MBA student and teaching Undergrad)

This is an interesting question. If a campus has programs that are governed by different regulatory bodies (i.e. certificate/diplome programs are regulated by TWC/Career Colleges & Schools; degree programs regulated by Accrediting body), then I suggest you carefully review the instructor requirements of the relevant regulatory entity. The TWC/CSC instuctor requirements are very specific but do not [to my knowledge] prohibit this scenario. However, I suggest you call the accreditor and/or TWC/CSC prior to implementation to be safe.

I was also curious about this regarding instructors. So far, we have not had that occur but good to know for future consideration.
