Can one use a sort pre-test as a judicial review type application ?

Yes you can in relation to establishing a baseline on students.

I feel that you can, and use the results to ecourage the student to focus on the less easy parts of the course. To often students try to complete what they know first and sometimes don't get to the parts they don't know. This leaves them a step behind and frustrated. The learning then slows and the student feels defeated.

Using a pre-test after welcoming students to your course,is a good way to gauge to knowledge they already have,and adjust as necessary to give them the knowledge they need to pass your course.

This is the reason I like and use pretesting. It helps me to gain insight into what my students know. Then I can plan my instructional delivery around their knowledge base.
