Activity

The U.S. Department of Education’s Office for Civil Rights (“OCR”) has stated that when schools do not hold perpetrators accountable through punishment or when the sanctions imposed are not commensurate with the seriousness of the act, the school is at risk for continuing to violate Title IX by allowing a hostile environment to continue.

A. The Clery Act requires institutions to show information about campus crime statistics, security policies, and procedures. It focuses on providing transparency regarding safety measures and procedures related to crime reporting, including sexual assault, domestic violence, dating violence, and stalking. However, the Act does not require institutions to show the disciplinary records of other students to current students or faculty.

A key role of a Title IX Coordinator is to educate the school community about sexual and gender-based harassment. This includes training all employees on how to recognize harassment, understand their reporting responsibilities, and respond appropriately when faced with such situations. This training helps create a more informed and supportive environment for students

Lesser-known aspects of the Violence Against Women Act (VAWA) include its vital housing and immigration protections, expanded tribal court jurisdiction, and broad anti-discrimination provisions that protect all victims regardless of gender or orientation. While most think of VAWA in terms of police and prosecutors, its impact extends into many other areas.

Critical immigration relief for victims
VAWA created specific immigration pathways to protect non-citizen victims of abuse who might otherwise be trapped in dangerous relationships out of fear of deportation.

A student's right to opt out of directory information is persistent. This will continue to apply until the student actively chooses to rescind their request. This means even if the student graduates or withdraws from the institution, their opt-out preference remains valid unless they inform the school otherwise. Although FERPA rights continue after a student is no longer enrolled, they do end upon the death of a student.

The best practice guidelines that are utilized by institutions add a level of protection for students’ privacy. Some of these guidelines may consist of:
•    Notification to the student about any information released.
•    Written permission of the student to allow disclosure of any educational records, including Directory Information.
•    Provide the students with ample time and means to submit a written request to have the institution refrain from disclosing Directory Information.

FERPA right: Under the Family Educational Rights and Privacy Act (FERPA), students have the right to inspect their educational records, request amendments to those records if they believe they are inaccurate, misleading, or violate their privacy.

Right to add a statement: If a student's request to amend their record is denied, they have the right to add a statement to their record explaining their perspective on the disputed information.

“The Family Policy Compliance Office (FPCO)” is authorized by the Secretary of Education to review complaints.
If the complaint is validated, then “The General Education Provisions Act (GEPA)” utilizes the following methods of enforcement for FERPA violations:
•    Issuing a complaint to compel compliance through a cease-and-desist order
•    Recovering funds improperly spent
•    Withholding any further payments
•    Entering into a compliance agreement
•    Taking any other action authorized by law, including suing for enforcement of FERPA’s requirements

Q: Complaints must be filed within what time period?

Limit the stares, the stereotyping, and yapping away, saying inappropriate comments or questions that can make people feel uncomfortable and feel they are being stepped on or looked down upon.

Disabled students are entitled to confidentiality of their disability information under federal laws, i.e., the Family Educational Rights and Privacy Act (FERPA), which requires written consent to share details with others and restricts disclosure to only those with a legitimate educational interest. Students have the choice to disclose their disability, and colleges must not include specific diagnoses on accommodation letters, but rather list the approved accommodations and how to provide them. Information is protected, and students can grant or revoke permission to share their information at any time.
