So first, in order for the person or company to enforce the copyright they have to first file for the copyright.
Most creators think they have an automatic copyright by date, which they may, but it cannot be enforced without filing.
Second and more important, the use of copyrighted material, and the prevention of the use thereof, is limited by the following exceptions :
Procedure- must register to enforce
Rights-except fair use-parody, education, critique
