There are some federal laws that have priority over FERPA. For example, the Solomon Amendment and the USA Patriot Act.

A student can include a statement in their academic record if it differs from what the institution has decided. This has to show up in all transcripts.

Student records for those over 18 cannot be released without permission to parents except when the student is determined to be a dependent by the IRS, there is an emergency, or the student is under 21 and has used drugs/alcohol. The latter is only if the state has not prohibited that exception.

FERPA applies to K-12 and post-secondary schools. It is a way to protect students and their information and is very important. If I do not abide by FERPA, the school will face an investigation.

Marketing needs to be ethical, and should not include any false or misleading statements. I need to ensure I get a copy of the marketing materials sent out to students so I can see what they are seeing. Additionally, any agent that gets their license suspended also opens up the school for an investigation.

It is important to be mindful of how I am phrasing things. For example, job placement can never be guaranteed. However, we can give the student all the tools and resources we have available so that they will hopefully do so.

A student does not have to sign all of the enrollment agreement right away, but they are not considered enrolled until doing so. Additionally, the enrollment agreement needs to include the total charges and the refund policy.

When going through the admissions process, it is important that I remain truthful, and ensure that the student has a full understanding of the enrollment process/program and what it would entail.

Relationship building and selling is not the same as going to the store and buying something from a cashier. I need to build a relationship with prospective students in order to get student enrollment. However, not everyone will be a good fit for enrollment. I will find this out through relationship building.

According to Bernard Ferrari in his book Power Listening: Mastering the Most Critical Business Skill of All, listening is purposeful . It also requires control as you have to steer and filter the information. Additionally, focus and engagement is needed.
